Terms and Conditions
1. Items tendered to Hot Shot Delivery, Inc. (“Hot Shot”) for delivery will be securely contained and fastened in properly addressed packages, which conform to United States Post Office rules and regulations, as well as all federal and state regulations applicable to private express shipments. Package shall not contain contraband or other illegal materials. Electronic media or other items which may be subject to magnetic or electronic damage will be contained in protective materials and clearly marked to indicate their contents.

2. Hot Shot will not be liable for any loss or damage caused by any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes including, without limitation, fires, floods, explosions, acts of God, riots, acts of war or terrorism, governmental actions, electrical failures, internet failures, strikes and labor disputes, insurrections, civil disturbances, the act, default, or omission of the shipper, addressee, or any other party with an interest in the shipment other than Hot Shot, including, without limitation, government officials and Postal Service employees.

3. Hot Shot will not be liable for any concealed damage. Loss or damage claims may not exceed fifty dollars ($50.00) unless (1) a greater value is declared, (2) an additional charge is paid, and (3) the greater value is accepted by Hot Shot. All claims for loss or damage must be made within seventy two (72) hours by faxing written notice detailing the claim to:

4. HOT SHOT SHALL NOT BE LIABLE FOR DELAY IN DELIVERY OR FOR INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, WHETHER OR NOT HOT SHOT KNEW, OR SHOULD HAVE KNOWN, THAT SUCH DAMAGES MIGHT BE INCURRED, INCLUDING, BUT NOT LIMITED TO, LOSS OF INCOME, LOSS OF PRODUCTION, INCREASE IN EXPENSE, INTEREST, PROFITS, BUSINESS OPPORTUNITY, BANK COLLECTIONS OR SIMILAR FEES.

5. Any item that must be stored because it is undeliverable for any reason not the fault of Hot Shot may be subject to a reasonable storage charge.

6. Unless previously agreed to in writing, Hot Shot will not transport items that require special handling. By way of example and not limitation, these would include human remains, tissues, or fluids, live or dead animals, hazardous materials, household goods and furniture, perishable items of any sort, or shipments unaccompanied by proper documentation.

7. Hot Shot may, at its option, open and inspect any packages tendered to it for shipment.

8. Hot Shot reserves the right to reject a shipment at any time before actual delivery if the shipment could cause damage or if it could delay other shipments or if the it would be prohibited by law, regulation, or the terms and conditions.

9. Hot Shot will not ship cash or negotiable instruments and will not be liable for such shipment.
